Police: One man sent to hospital after cigarette skirmish


AUSTIN (KXAN) – A disagreement over a cigarette near downtown led to one man getting smashed over the head Saturday night with a rock the size of a softball, according to an arrest warrant.

The incident occurred at the Whataburger located at the intersection of South First Street and Barton Springs Boulevard. The victim told police Steven Hopkins, 26, asked him for a cigarette in the restaurant parking lot, and the victim declined.

Hopkins later came up behind the victim and, with an “overhand downward strike,” hit the victim on the top of the head with a softball-sized rock, according to the affidavit.

Police said victim was transported by EMS to an unnamed hospital. Surveillance video of the incident showed Hopkins picks up a rock, but the alleged assault took place outside the scope of the camera, according to the affidavit.

Hopkins has been charged with assault with a deadly weapon, a second-degree felony.
