AUSTIN (KXAN) – An Austin man drove while intoxicated Sunday afternoon and struck a child with a truck outside a Southeast Austin flea market, police said.
Authorities have charged Benigno Remollar Jaimes, 49, with aggravated assault with a deadly weapon, a second-degree felony, and driving while intoxicated, a third-degree felony in this case. The crash and arrest took place at 812 Outdoor Market located on FM 812 south of Austin-Bergstrom International Airport.
Jaimes was convicted in 1986, 1988 and 2012 for DWI. In the 2012 case, Jaimes had a passenger under the age of 15, making the offense a felony, according to Texas Department of Public Safety records.
The child injured was checked by emergency officials but the injuries are not clear from the affidavit.
Police said several witnesses at the scene pointed to Jaimes as the man who hit the child and a pole with the truck.
