Large pothole in San Marcos being repaired after concerns

SAN MARCOS, Texas (KXAN) — A pothole that had grown to small-car sized proportions in San Marcos at one of the entrances to the Stonecreek Center Shopping Center at I-35 and McCarty Lane is finally being fixed.

The hole has had many in town wondering why it had not been addressed. 

The short answer: the hole itself is located on private property — not on public property. The City of San Marcos said in an email: 

“TxDOT indicates that private driveways along TxDOT highways are the responsibility of the commercial/private owner. When a commercial/private owner receives a driveway permit from TxDOT, the permit states that maintenance is the responsibility of the permittee.” 

Even though the hole is located adjacent to the access road of I-35, TxDOT is not responsible for it. 

The Owners of Stonecreek (Clearview Investments), however, stepped up to repair the pothole. They are not the owners of the parcel in question. The work will be completed this week.
