HAYS COUNTY, Texas (KXAN) — The Democratic candidate for Hays County Commissioners Court Precinct 3 tells KXAN he filed suit to contest the November election results.

Democrat Jimmy Alan Hall lost by 37 votes in November to Republican Lon Shell. Hall received 10,058. Shell received 10,095 votes.

Hall asked for a recount after the election and the result did not change.

Hall claims voters were turned away to other precincts and their attempts to vote were frustrated by confusing and contradictory advise from election workers around Texas State, where outraged students fought to open polling locations with Hays County.

“Voters who reside and were registered in Hays County were given provisional ballots when they should have been given regular ballots. A large percentage of those ballots were rejected, namely 88%, disenfranchising those voters,” Hall writes in the lawsuit, “Voters who reside and were registered in Precinct 3, Commissioners Court, (voting precincts 301-339) were given ballots for Precinct 2.”

A phone call and email to Lon Shell requesting comment has not yet been returned.
