Law enforcement testifies in federal trial of accused kidnapper

ROUND ROCK, Texas (KXAN) — Colorado law enforcement provided a statement Thursday on the fourth day of the federal case against a man accused of kidnapping two sisters from their home on New Year's Eve 2017.

Terry Allen Miles, 45, faces federal charges after police say he took two girls, ages 7 and 14 at the time, to Colorado. Both girls were found unharmed and Miles was indicted on kidnapping charges by a federal grand jury in February 2018.

Darian Dasko of the Aurora Police Department in Colorado took the stand for the prosecution to give a statement about the day Miles was taken into custody, on Jan. 3, 2018.

According to Dasko, he responded to a suspicious vehicle tip call for a "very dirty" grey Honda Accent at the Potato Patch Campground off of Highway 12, which also matched the vehicle description in the Amber alert for the girls.

Dasko testified that when he approached the entrance to the campground he identified the car. The deputy stated the car had no front license plate and he could not make out the rear plate due to excessive dirtiness. When Dasko exited his patrol car to approach, he reported that the vehicle took off toward Highway 12. 

According to the testimony, what followed was an erratic pursuit down the highway, where the fleeing vehicle would slow to 30 miles per hour, then speed back up to 55 miles per hour. Dasko stated that he called additional officers for assistance and once backup arrived he was ordered to initiate a felony stop with lights on.

The stop occurred on the side of the road and Dasko testified that he exited his patrol car with his weapon drawn. Miles was detained and later identified with a Louisiana ID. The two girls were also found in the vehicle and were given to EMS for medical exams.

According to the defense's cross-examination, Miles made no indication that he was fleeing from officers, citing that he never exceeded the speed limit. In addition, no communication was given to Miles before the stop was initiated.

As of Monday, the teen girl is in a Texas group home while her younger sister is with a placement family who is in the process of adopting her, according to Lisa Block with the Texas Department of Family and Protective Services. The next permanency review hearing is scheduled for April 5. 

Miles faces between 20 years and life in prison if convicted, according to the U.S. Department of Justice.
