Family wins $5.2 million in lawsuit against TxDOT over 2016 crash

AUSTIN (KXAN) — A Travis County jury awarded $5.2 million dollars to the family of two crash victims on Friday. 

A lawsuit filed by the family claimed TXDOT knew of unsafe road conditions in the area. 

In May 2016, Alfonso Lopez and his father Jose Lopez Garcia were killed in a roll-over crash on U.S. Highway 290 between Elgin and Manor. 

The truck the two were traveling in reportedly veered off the road when the rear tires lost control in the rain. 

The crash happened near the intersection of Hwy 290 and Voelker Lane. Manor police say a truck was heading eastbound on 290 when it drove into the median and rolled off the road.

The lawfirm representing the family says that Manor Police let TXDOT know about the wet weather crash history one year before the incident. 

Following a fatality on October 23, 2015 in this precise area, the lawfirm argued that TXDOT did not work to improve traction in this stretch of road. 

Crews went to work to fix that section of the road where the truck lost control 16 days after the 2016 crash.
