AUSTIN (KXAN) — A new arrest warrant has been issued for a man accused of killing a passenger of his vehicle while driving drunk.
According to the warrant, Cedar Creek resident Oscar Benitez-Patino did not show up for his sentencing in the incident that occured in August 2018. According to the warrant in the 2018 case, Benitez-Patino was driving with Juvenal Martinez, 21, near the Austin-Bergstrom International Airport at high speed when he was unable to stay in a single lane and lost control of the vehicle.
The vehicle rolled over and Martinez was pronounced dead at the scene. Inside the car, officers said they found an empty box of beer, an empty beer can and and empty beer bottle. Almost 1.5 hours after the crash, Benitez-Patino’s blood alcohol count was between .190 and .207, which is 2.5 times the legal limit.
