Walmart hit-and-run victim sues AISD officer for more than $1 million


AUSTIN (KXAN) — A woman who was captured on video being run over by a truck in the parking lot of a south Austin Walmart gas station is suing the alleged driver for more than $1 million.

According to a search warrant, 33-year-old Adam Marsh is suspected of hitting Michelle Gonzales while she was walking at the station on East Ben White Boulevard near Interstate 35 and driving off on Feb. 9, 2018. Marsh was an Austin Independent School District officer at the time, although he was off duty. A district spokesperson said on March 1 he was placed on administrative leave, and confirmed Wednesday he is still on leave.

The lawsuit says Gonzales “was squarely within the light shining from Defendant’s truck’s headlights. Plaintiff crumpled to the ground from the force of the collision. Defendant then proceeded to drive over Plaintiff, crushing her under the weight of his truck.” Video police released at the time while searching for a suspect showed the truck driving off after hitting her, and the lawsuit highlights the suspect did not call for help.

Gonzales is seeking monetary relief of more than $1,000,000, although a jury will have to decide the actual amount, if any.

Criminal charges have not been filed against March, however the district attorney’s office will present the case before a grand jury instead of pressing charges up front. The date for that has not yet been set.
