SPICEWOOD, Texas (KXAN) — A fatal shooting in Burnet County Wednesday began as a road rage incident, according to the Burnet County Sheriff’s Office.

Around 2 p.m. Wednesday, first responders arrived at the Spicewood Square Chevron convenience store at 10115 E. State Highway 71 and found Thao Ton, 44, had been shot twice. Ton died at the scene.

BCSO said Ton and another driver, 36-year-old Milton Kim, “had been involved in a non-collision road rage incident” and pulled into the parking lot together. An argument began, and witnesses told officials that Ton had assaulted Kim as he was sitting in his car. Kim is then accused of shooting Ton.

SH 71 traffic was affected for a time as law enforcement investigated.

Kim had a valid Texas License to Carry at the time, BCSO said. It added that he cooperated with the investigation. The case has been referred to the District Attorney’s Office, but it is not known if charges will be filed.
