Travis County Deputies found 28-year-old Nicholas Randal Burr on his back on the front porch of the home with an apparent gunshot wound to his abdomen and additional injury to his head. He was pronounced dead around 1:48 a.m.
Walton told officers on scene that while he and Burr were arguing, Burr grabbed a shotgun from behind the refrigerator on the porch. According to the arrest affidavit, Walton told responding deputies that he and Burr struggled over the gun and that his roommate then pointed the gun barrel at his own stomach. Walton said the gun went off during their struggle and that he didn't know how.
Walton and Burr's roommate, Jefferey Gazaway, witnessed the shooting and told deputies that it started with an argument between him and Walton and that Burr had tried to intervene. According to the affidavit, Gazaway stated that after the argument cooled down, he and Burr went outside to smoke a cigarette.
Gazaway told police that Walton then came outside, holding a shotgun and pointing it to Burr's head. He said that Walton then used the butt stock of the gun to strike Burr on the left side of his head. Gazaway stated that he went to get help at a neighbor's house when he heard a single gunshot.
According to the affidavit, Gazaway also stated that the gun belonged to Walton and that it was kept inside his bedroom and not outside on the porch.
