AUSTIN (KXAN) - A man who got angry with his neighbors child he says was being too loud, is now in jail.
Police responded to 12118 Walnut Creek on a noise violation call.
According to an arrest affidavit, Baldomero Delfierro, 38, told 911 dispatchers "if thing's don't quiet down he is going to shoot someone." Delfierro also told dispatchers "if officers were not there soon" he was "going back up there and the "resident will not be happy."
When police arrived they spoke with Delfierro's neighbor above his unit. The neighbor said Delfierro had come up and banged loudly on his door. The affidavit also says Delfierro threatened to return with a baseball bat and hurt the neighbor and his family if the noise didn't stop. The neighbor said Delfierro also threatened to return with a gun if the children didn't stop banging on the floor.
When police spoke with Delfierro he said the noise happens every day until 2:00 a.m. and told police if it didn't stop he was going to go upstairs to "kick their asses and that he didn't care about their lives."
Delfierro told police he owned a gun but he had "no intention of using it." Police warned him that if he assaulted them he would be arrested. He told police that "he didn't care," saying "he would go upstairs right now and kick their asses if that's what it takes."
The responding officer feared a confrontation with Delfierro and his neighbors and placed him under arrest, charging him with terroristic threats.
Delfierro is currently in the Travis County jail with a bond of five-thousand dollars.
