Michael Scott and Robert Springsteen are being re-tried in the 1991 murder cases.
The two men walked into court for another pre-trial hearing. This time, their attorneys were asking for new DNA testing of the physical evidence gathered at the crime scene. The evidence includes clothing from the four victims, vaginal and oral swabs, as well as saliva, blood and hair. Defense attorneys want these items to be retested using more sophisticated DNA testing technology that was not available during the original trials.
Judge Mike Lynch told the two sides to narrow down the list before he would grant the motion. He said he is concerned about testing items not relevant to the trial and wasting taxpayer dollars.
Scott and Springsteen are accused of sexually assaulting four girls, killing them and then burning down the I Can't Believe It's Yogurt to cover up the crime.
An appeals court overturned the first convictions in the case.
A trial date has not been set for either man, but Judge Lynch said they will be tried back to back sometime soon after the first of the year. The next hearing is scheduled for late October.
