AUSTIN, Texas (KXAN) -- One of the men charged in Austin's 1991 yogurt shop killings appeared in court for a pretrial hearing Tuesday.

Michael Scott and Robert Springsteen will be retried in the case after an appeals court overturned their convictions in the murders of four teenage girls at the I Can't Believe It's Yogurt shop.

The majority of the hearing took place behind closed doors in the judge's chambers.

Attorneys had worked out several issues before the hearing, but an attorney for Springsteen refused to participate in the proceedings.

"Since my client is innocent, I think everything should happen in open court, and I think that the public deserves to know as much as it wishes and participate, so that they can know everything a jury is going to know," said Joe James Sawyer, Springsteen's attorney.

The next hearing for Scott will take place in two weeks. His trial is set for the end of May.
