AUSTIN (KXAN) - The Texas Pardons and Paroles board is making an unusual recommendation, calling on Governor Perry to pardon a man who died in prison.
Tim Cole was convicted in 1985 for the rape of a Texas Tech student in Lubbock.
He died behind bars fourteen years later. Before Cole died another man confessed to the crime. But it wasn't until 2009 that his conviction was reversed. DNA evidence proved Cole did not commit the rape.
If Perry grants it, it would be the state's first posthumous pardon.
