Caller: Sheriff deputies behaving badly

Cops: Deputies let waitress take photos with gun

AUSTIN (KXAN) - Sheriff deputies from Midland County, Texas are being investigated on allegations that they posed a restaurant employee in front of their patrol cars, holding a gun, in a Round Rock restaurant parking lot on Monday night.

While the pictures were not available for viewing and were not described at length in a police report obtained by KXAN Austin News, the restaurant was Twin Peaks- known for its scantily clad waitresses.

It was around 10:30 p.m. Monday when Round Rock police got a 911 call about a suspicious incident.

Officers arrived at the Twin Peaks Restaurant and Bar at 100 Louis Henna Blvd. to find an unusual situation had taken place in the parking lot.

According to the incident report, a waitress from the restaurant was in the parking lot with five Midland County sheriff deputies apparently holding one of their patrol rifles.

The report states the deputies, who were in the Central Texas area for training, were taking pictures of the woman while she was holding the gun.

The camera was confiscated by Round Rock police, and the deputies are being investigated for disorderly conduct.

The Midland County Sheriff’s Office said no criminal charges have been filed.

"It is under investigation," said Midland County Sheriff Gary Painter.

The Williamson County attorney was looking into this situation for misdemeanor charges, but now it is in the hands of the district attorney, which could mean felony charges.

Williamson County District Attorney John Bradley is out of town. During a telephone conversation, he said he will personally review this situation, especially since there is concern about official misconduct.
