Burnet Co. man sentenced for accident

Man had history of seizures before 2010 accident

BURNET, Texas (AP) - A judge has sentenced a Texas man with a history of suffering seizures to three years in prison for a deadly 2010 traffic accident.

The Austin American-Statesman reports Troy Dean Klaerner was sentenced Friday after pleading guilty to manslaughter earlier this year. Prosecutors had sought a 10-year sentence, but state District Judge Guilford Jones III noted 49-year-old Klaerner's remorse, as well as his ongoing health issues and the cost of keeping him in custody.

Court documents showed that seven days before the crash that killed 39-year-old Christopher Lee Smith on a bridge over Lake Marble Falls, a neurologist told Klaerner to stop driving.

The Texas Department of Public Safety says people with epilepsy can generally drive as long as they have not had a seizure in six months.
