AUSTIN (KXAN) - The blood-alcohol levels obtained through blood search warrants in Burnet County has averaged nearly three times the legal limit. During a driving while intoxicated training session in Marble Falls Tuesday, Marble Falls Police reported that out of the 13 blood draws they have done since their program started in October of 2008, the average blood alcohol level was .22. Unlike the city of Austin who targets certain holiday weekends, Marble Falls blood warrant program takes place around the clock.
"It's worth the time if we can keep our streets that much safer," said Sgt. Barry Greer with the Marble Falls Police Department. The patrol supervisor who has made one of the blood warrant stops, said he has seen a change in his officers since program started. "They're more proactive in going out, looking for them because they know there's a better chance of a conviction."
The process could get easier for officers like Greer. State Representative Dan Gattis filed HB 747, which will allow police officers to obtain blood or breath samples from individuals when there is probable cause to believe the driver is intoxicated. They must fit a certain criteria:
"We must protect innocent individuals and families from those who have a clear disregard for the law," said representative Gattis. "This bill targets the most serious DWI offenders, holding them accountable for their actions."
Under Rep. Gattis' bill, first and second time DWI offenders can still refuse a breath or blood test, unless there is serious injury to another party or a child is in the vehicle. This bill is aimed at reining in those who repetitively break the law.
