Unwanted visit leads to burglary arrest

AUSTIN (KXAN) - A woman in South Austin awoke to a frightening experience when she discovered a naked man whom she did know laying on top of her in her home.

The incident happened in the 4800 block of East Riverside Drive at around 1 a.m. Thursday.

According to the police affidavit, the victim arrived home and forgot to lock her front door before she went to bed. She woke up to find the suspect, identified as 44-year-old Javier Martinez, naked and lying on top her, whispering to her in Spanish and kissing her neck and face. She pushed him off and was able to get him out of her apartment and immediately called police.

Martinez later was located and detained after he was spotted walking through the same apartment complex.

The victim told police that Martinez did not undress her or sexually assault her, but police said they believe that was his intention.

A week prior to the incident, the victim said she saw the same man watching her as she walked into her apartment. He later knocked on her door, but she did not answer or notify police at the time.

Martinez has been charged with burglary of a habitation.
