AUSTIN (KXAN) - The sons of Hays County Sheriff Gary Cutler are facing felony burglary and drug charges in Travis County stemming from an incident last October.
Trevor Cutler, 31, is charged with marijuana possession while his 34-year-old brother, Travis Cutler, is charged with burglary and drug possession.
Sheriff Gary Cutler released a statement saying his sons are adults who live in Travis County and all questions about their legal issues should be directed towards their attorney.
According to an arrest affidavit, Austin police were called on Oct. 24 to a burglary by Travis Cutler’s girlfriend at the home owned by both brothers on Cherisse Drive in southwest Austin.
While investigating the burglary, they were able to find some of the stolen items to Jeffery Borho’s home. The items included glass jars which contained a substance which appeared to be marijuana.
A search of the Cutlers' home found other drug paraphernalia including grow lights, clear bags with marijuana reside and tablets consistent with 5-methoxy-diisopropyltryptamine.
Travis Cutler was also charged with burglary for an incident that happen a few days before when Borho said Cutler broke into his home to steal several items including a laptop, two iPads, and cash.
Borho said that burglary was what led to him break into Cutler’s home a few days later in order to get his items back.
Cutlers' attorney, Joe Turner, said the charges are suspicious because both brothers were out of state at the time of the burglaries, and the drug paraphernalia was found while police were investigating a burglary at the Cutlers' home.
Back in 2009, an arrest warrant was issued for Travis Cutler after an officer said he found heroin in his car during a traffic stop. That case was dismissed.
