AUSTIN (KXAN) - A former Texas legislative aide accused in a deadly hit and run appeared in court on Friday.
Gabrielle Nestande is charged with intoxication manslaughter, manslaughter, and failure to stop and render aid in the crash that killed Courtney Griffin.
Investigators say in May 2011 Nestande was driving drunk when she struck Griffin with her car in West Austin. Officers say Nestande then drove off.
Nestande's trial for failure to stop and render aid was supposed to start in October, but shortly before a judge indicted her on the two more serious charges.
A new trial is set to start in February. Jury selection will begin on Feb. 11.
In court Friday, Nestande's legal team asked for a judge to withhold some evidence in the case.
Griffin's father, Bart Griffin, told KXAN News he didn't understand what Nestande's attorneys could possibly want to hide.
"Let's get to the truth and let's move forward," said Griffin. "She's refused to accept responsibility. When does a person have to be accountable for their actions anymore. I don't like it at all."
Bart Griffin and others have been working with the Texas Legislature to change the laws to increase the severity leaving an accident scene when a person dies. Griffin wants that to be treated as a second degree felony.
