AUSTIN (KXAN) - A man who accused Austin police of using excessive force appeared in court Thursday.
Antonio Buehler was arrested on New Year's Eve after he took pictures of APD officers who stopped a woman suspected of driving drunk as they arrested her.
Buehler said officers unjustly arrested him, and used unnecessary force, as they were angry that he photographed the arrest of the woman.
Police said Buehler spit on them, which he denies. He has filed a complaint with the Austin Police Monitor's office .
Austin Police Cpl. Anthony Hipolito said in January that spitting in an officer's face is an automatic third-degree felony.
APD has not yet released video of the arrest.
Buehler's next court date is set for March 26 for pre-indictment.
