3 arrests following Occupy ATX march

AUSTIN (KXAN) - Joshua Pineda and Luke Smith have been charged with criminal trespassing after refusing to leave Highland Mall.

Today, a handful of Occupy demonstrators were at the jail waiting for their release.

About  30 protestors were starting a march at the mall to the abandoned Home Depot on St. John Avenue and Interstate 35. The Home Depot location was were Occupy Austin hoped to build "Tent City."

A security guard contracted by the mall informed the demonstrators they couldn't be on the property. When all but two listened, police got involved.

The security guard let Pineda and Smith know the property line start at the curb. Pineda continued to stand 6 inches from the curb refusing to leave. The cop told him twice to leave, then placed him under arrest.

A second officer told Smith to leave. He did step off the curb but immediately came back onto mall property, leading to his arrest.

The rest of the protestors were then met by police again at the abandoned Home Depot. There, a third unnamed protestor was arrested by police.

The officers also stopped "Tent City" from going up. The Occupiers attempted to place the site across the street on private property but it was taken down by the end of the night.
