AUSTIN (KXAN) - Police are investigating a deadly shooting at an East Austin arcade on Manor road, near Airport Boulevard.

The arcade manager was closing up the facility when a man with a knife allegedly approached the entrance of the business to rob the arcade.

Police said that's when the manager and the man got into a struggle. The manager grabbed his gun, shot the man down and then called 911 -- at 1:04 a.m.

When Austin-Travis County Emergency Medical Services arrived, crews tried CPR on the man but pronounced him dead from the gunshot around 1:30 a.m.

The man who was shot was identified Wednesday afternoon as Byron Ray Maxwell, 36. Public records show he was convicted of a misdemeanor assault strangulation charge in 2010 and also was arrested for failure to appear at a child support hearing in Travis County.

"[The] manager was the only one in the business at the time, possibly other witnesses that homicide is interviewing," said Senior Police Officer Dennis Farris.

Farris said the manager has been very cooperative with police.

Police said the investigation is ongoing and have not determined if any charges will be filed. However, late Wednesday, APD announced Maxwell's death as Murder No. 24 in the city of Austin.

An APD homicide sergeant will talk at APD Headquarters about the case on Thursday at 10:30 a.m.

Previous game room incidents

The same game room was the site of a police bust on June 16 as an illegal gaming room. At the time, seven people were arrested on charges of illegal gambling and possession of a controlled substance. APD seized cash and gaming machines.

Those arrested in June were:

  • Wulfrano Carrillo, 18
  • Paula Evans, 19
  • Gumesiendo Ibarra, 64
  • Wesley Francis, 55
  • Juanita Jackson, 41
  • Paula Kennedy, 58
  • Juan Sosa-Espinosa, 33

In an unsolved case from 2003, a man named Abraham Macedo died in the same shopping center where the game room is located. He was the owner of a music store and was robbed by three men at closing time.
