AUSTIN (KXAN) - A 61-year-old man was arrested on Monday after witness accounts and security video showed his vehicle ran over three people in a parking lot as they tried to exit their car, which was parked in a handicap space at the tax office. Police said Charles Cudd attempted to drive away after he hit them.
The victims include a 3-year-old girl, who suffered bruising and abrasions to her abdomen, back and right thigh.
Hospitalized in fair condition after the incident is Gloria Fabian, with a broken femur. Moses Fabian suffered much bruising and severe pain in his left ankle, officials said. He is not hospitalized. She said she was terrified during the incident.
"I'm holding onto the door of my car, and the door hits my car and when he pulled me forward it took my baby away from me." she said. "And I thought he killed her because I couldn't see her and the man came again and that's when he pulled me out of the car... when he hit my door again my leg caught between the door and the car and I knew my leg had to be broken."
According to an arrest warrant affidavit released Wednesday, Charles Cudd is charged with failing to stop and help after his car hit the three family members in the parking lot of the Travis County Tax Assessor-Collector's office at 5501 Airport Blvd.
Several people told police they saw the incident and that Cudd, who was with his wife in the car, attempted to speed off before he was detained by witnesses. Security video corroborated the witnesses' accounts. Witnesses said the woman allegedly threw beer cans out of the car and admitted to drinking.
Charles Cudd was given a field sobriety test and told officers that he had taken prescription medication earlier in the day. His bail was set at $50,000.
