AUSTIN (KXAN) - After delaying service for a fourth time, new documents show Capital Metro's MetroRail service had more than 20 violations on a recent inspection. The violations reveal more than Capital Metro officials disclosed in recent statements regarding the service delays.
Documents obtained under Texas State Open Records law show the Federal Railroad Administration cited Capital Metro and its contractor Veolia for failing to keep up to date records on testing, and program completion for its train operators. The FRA noted 22 violations in its March 11 and March 17 inspections.
Many of the violations stem from two incidents that occurred on Feb. 18 and 19, when two Capital Metro trains failed to get clearance to turn around on the track near Leander.
FRA Inspector Randy Caldwell noted 18 additional violations surrounding the incidents. Caldwell noted that CapMetro failed to administer drug and alcohol tests to the train operators after the violations and failed to revoke the certificates of the train conductors' supervisors.
In addition, though he did not recommend a violation, Caldwell also noted that five of the train's conductors did not keep proper records of their hours of service-off duty.
CapMetro has said the problems stem from its rail contractor, Veolia. CapMetro President and CEO Fred Gilliam called for the immediate firing of Veolia's safety director.
"Capital Metro is deeply disappointed over this delay, but under no circumstances will we jeopardize safety by rushing this process," said Gilliam two weeks ago.
Veolia released a statement saying it is working with the FRA, TXDOT and Capital Metro to get the correct paperwork submitted and filed.
"We will be presenting to the FRA evidence to mitigate the recommended violations cited in the Inspection Reports," said the statement.
Veolia said the violations put "...none involved risks to persons or property."
While that part is true, said FRA Spokesman Warren Flatau said, "it's something that is absolutely unacceptable." Flatau said.
"The onus is on Veolia and Capital Metro to do what they need to do."
Capital Metro officials have said they will update the public on a new opening date on May 15.
