CORPUS CHRISTI, Texas (AP) - A judge said she will likely suppress a critical piece of evidence in the case against the man accused of filming orchestrated fights among the residents at a Texas facility for the mentally disabled.
Timothy Dixon's defense asked to suppress the use of a cell phone containing videos of the abuse at the Corpus Christi State School .
District Judge Sandra Watts said as she reads the law now, the phone cannot be used as evidence because it was effectively stolen property. Watts offered prosecutors more time to find case law supporting using the cell phone at trial.
An attorney for D'Angelo Riley, another former employee of the facility, told Watts he may agree to plead guilty to two counts and avoid trial.
