Death in March now called a homicide

New classification puts 2012 homicide count at 33

AUSTIN (KXAN) - Austin police have reclassified a death originally thought to be a result of a self-inflicted gunshot wound.

According to police, officers responded to a check welfare call at 615 Thrasher Lane at 9:35 p.m. March 11, 2012.

When police arrived they found a man, later identified as Lee Martinez, 28 with a gunshot wound. Martinez was transported to University Medical Center Brackenridge where he was pronounced dead at 12:03 a.m.

In the initial investigation, responding officers were led to believe the wound was self-inflicted. Homicide investigators later discovered that another resident at the address fired the weapon.

Martinez’s death was brought before a Travis County Grand Jury on Oct. 11 as a "criminally negligent homicide." The suspect in the case was no-billed and Martinez's death was ruled a homicide.

The newly classified case brings the total homicides for Austin in 2012 to 33.
