AUSTIN (KXAN) - A former Austin police officer accused of paying a prostitute for sex while on duty was convicted on a drug charge Tuesday.
Scott Michael Lando faced several charges of prostitution, delivery of a controlled substance and aggravated assault by a public servant for incidents that go back to May of 2006.
The jury convicted him of delivery of a controlled substance. Prosecutors now have to decide if they want to move forward with the other charges.
At about 4 p.m. Tuesday, after days of testimony, the jury sent the judge a note saying they were at a 10-2 impasse and that no further deliberations would do any good.
The judge asked them about the recent movement in those votes and since it was 9-3 yesterday, he told them it seemed as though they were getting closer to a unanimous vote and asked them to take another 45 minutes to see if any progress is made.
They returned a verdict just after 5 p.m.
Sentencing was set for Sept. 9.
