AUSTIN (KXAN) - Austin police arrested Robert Cardenas, 29, Sunday after they said he failed a sobriety test during a traffic stop.
Police said they noticed the red Chevrolet four-door car with a young boy hanging out the back passenger side window and heard loud music coming from the vehicle in the 700 block of northbound I-35. The officer stopped the car to conduct a welfare check on the child.
The officer found two children in the car: a 10-year-old boy and a 12-year-old girl.
Police said they detected a strong odor of alcohol and that Cardenas swayed when he stood near the vehicle. Cardenas reportedly told the officer he had had three beers.
Still, Austin police said he failed the sobriety test.
Authorities arrested Cardenas and charged him with driving while intoxicated with a child passenger, a state jail felony. He has no previous convictions for DWI on his record.
