AUSTIN (KXAN) - Juan Deanda and Capitol City Disposal Inc. was indicted for 26 counts of illegal dumping. Illegal dumping is when someone intentionally and knowingly, for a commercial purpose, dispose of litter or waste at a place that is not an approved waste site.
In this case, they are accused of dumping glass, scrap metal, paper, cardboard, plastic, wood, concrete pipe, insulation, construction materials and demolition debris.
Allegedly, the company dumped items over the course of two years. Each instance, the waste allegedly weighed 200 pounds or more.
The grand jury alleges that Capitol City Disposal, Inc., by and through Juan Deanda, a high managerial agent acting on behalf of the corporation and within the scope of his office and employment, are responsible for the illegal dumping.
The Capitol City Disposal, Inc. had previously been convicted of an offense under Section 365 of the Texas health and Safety Code on Sept. 12, 2005 in the Travis County Court of Law No. 6.
