EDINBURG, Texas (AP) - A U.S. Customs officer is scheduled to be charged with murder over the shooting death of the owner of a south Texas bar while the lawman was off duty.

The Hidalgo County Sheriff's Office said Jose Elizondo faced arraignment Tuesday in the death a day earlier of Fermin Limon, owner of the Punto 3 Night Club in Mission .

Authorities said Elizondo and his brother were thrown out of the club for fighting with another man.

Elizondo allegedly went to his truck, returned with his government-issue weapon and shot Limon twice. Elizondo told investigators he thought the 49-year-old Limon had a gun.
