KILLEEN, Texas (KXAN) - A pro-life legal group asked the U.S. military to charge Major Nidal Malik Hasan with the unlawful killing of an unborn child during the Fort Hood mass shootings.

The initial 13 premeditated murder charges were filed against Hasan on Thursday. They include Francheska Velez, 21, but not the child she was carrying.

Velez was 3-months pregnant and would have started her maternity leave in December.

The Alliance Defense Fund issued a ltter to the Office of Staff Judge Advocate at Fort Hood, urging the enforcement of Article 119a of the Uniform Code of Military Justice, which makes it a crime for anyone to "cause the death...of a child, who is in utero."

A Killeen attorney said if the shooting happened off-post, Hasan would likely face charges for the death of the unborn child.

"In Texas, someone who kills an unborn child can be charged with that as a seperate crime, other than the killing of the mother," said Kyle Pinkerton, an attorney. "There's the prenatal protection act."
